10.17.14 – As expected, Tetra Technologies Inc. (Tetra) has appealed four of Orange County Superior Court Judge Gail Andler’s recent decisions upholding the governmental approvals and environmental review of the Cadiz Project under the California Environmental Quality Act. Tetra was the petitioner in four of the six cases before Judge Andler. With the filing of the notice of appeal by Tetra, the legal process to ready the cases before the Court of Appeals can now begin. Our expectations regarding the completion of required tasks in advance of Project construction remain unchanged by this appeal.
We remain confident in the fairness and thoroughness of the environmental review conducted by the Santa Margarita Water District and San Bernardino County and further we take great pride in knowing that Judge Andler’s rulings confirmed that we achieved our objective of designing a water project that can help solve systemic water shortages in California in an environmentally benign way. Along with Santa Margarita and our public agency partners, we look forward to continuing to progress the Cadiz Project to its prompt completion.
